Real and Personal Property
Your Sweet Little Bundle of Rights
Your personal ownership of any property is defined legally as a bundle of rights. This bundle includes all the rights and interests in the thing owned by you. For example the right to enjoy, change, sell, encumber, give away and more, all belong to you within the limits of the law.
In real estate these rights apply to the land and things affixed to the land (as well as easements and appurtenances).
Generally speaking, real property is that which is immovable by law, unlike personal property such as your computer or automobile.
While land is easy enough to identify as real property, did you know that anything affixed permanently with something like a nail or screw can be deemed real property too? Real property can also include vegetation, such as your favorite rose bush.
When preparing your home for sale it would be wise to think over the things that are important for you to take (like Grandpa's chandelier) and switch them out prior to listing your home. The same holds true for that favorite rose bush, which can be potted and replaced with something just as nice. In the event you cannot make the changes before entering a listing contract, be sure your agent specifies the real property which is not included in the sale in your contract.
